to Ken's comments. I would tend to think that the judge would take the circumstances into account as well as the fact you have a clean record. It was an honest mistake and it happens....Good luck

I'm confused as to whether this is real or not... but in NY I believe if something is a misdemeanor, which I think shoplifting that that $ amount is?? there is a way to have them clean the system of your finger prints and information since it's not a serious offense. I know my friend is currently doing this because of a DWAI. That sucks if this is real because it has to happen pretty often. I know when I worked at a grocery store it was a cashiers duty to look in the cart and see if anything is on the bottom.

Also, when I worked at Price Chopper in NY, it was store policy that first time offenders were offered a chance to pay a $75 fine and leave empty handed never to return or have the cops show up and make the arrest. Most people gladly paid the $75 and said goodbye. I'm surprised they didn't do that since it's not really worth their time to go to court and everything. Whatever. I say if you are clear and free of all charges that you sue over mental distress and, if nothing else, make those two tool's lives inconvenient for a while. Or slash tires.

I think that's extortion by definition. "Extortion or outwresting is a criminal offense, which occurs when a person either obtains money, property or services from another through coercion or intimidation or threatens one with physical or reputational harm unless they are paid money or property." Source

Basically they're concealing a crime for a payment of $75. Kind of falls under the "pay up or else" definition.

Your screwed in a couple ways....regardless of what you say you still walked out with 2 bags of 50lb dog food bags (which i don't know HOW you didn't notice it under your cart cuz dat sheet heavy). They have a good case against you because basically you were caught red handed. Another bad thing is if these guys want to "make you an example". You hear petti cases all the time that goes to full extents just to "make an example". Hopefully this is not one of them. If this is the Clark shoprite, good luck, those guys are mofo's. The security gaurd is defenitly on a power trip and is looking to move up to deli!!!! Let us know what happend at the trial
