when i put it together i noticed it was all the way in on mine.. but do you see a potential problem with it being on his?

LEVI - DON'T USE THE MOTO-TOTE!
Your hitch is not rated for the tongue weight!

From the looks of the pic it doesnt fit all the way into the hitch, so I am sure that contributes to the problem as well.

Any word from levi if he made it ok.

it may very well be both.

Levi said the hitch is rated to handle the carrier. I looked on the DrawTite website and can't find anything with a tongue weight over 400lbs for his car. The bike and carrier combined has to be around 525-550 lbs.

I was Levi at WCW, so I know he made it ok. As far as him getting back I cannot attest. Even Ron was like, "Dude did you see that thing..."

I wouldn't trust it, if you plan on using it make sure to look for stress signs such as cracks before each trip.

Throw on some carbide scags, stud the track and look out!
