No way man...not in this kind of case...I've worked in supermarkets/catering...this stuff happens ALL the time to the point where there is usually one of them bubble mirrors on the other side for the cashier to look. At the very least the cashier is supposed to be trained to make sure everything on/in the cart is rung up. On the flip side, they failed to do their job.

I went food shopping on Sunday. I told my wife about this as we walked into the store. Even made a joke when I put a case of snapple on the bottom of the cart. Guess what, I still forgot it was down there when I was paying. Luckily she didn't. I asked the cashier how often does that happen and he said a lot. And it's obvious when someone is doing it on purpose, they try to stand in the way so he can't see it even though he's trained to look under there. Unlike me who just stands behind the cart staring at all the boobs on the chick magazines while my wife unpacks the cart.

This sounds alot like a movie I once saw. Look on the bright side, at least they didn't try to pin the murder of the cashier on you.
I have the name of a lawyer you might want to contact.
