That doesn't look too bad to fix. I would also get another straight set off ebay or the sale forums. Then you can use these as spares.
NYC streets do suck though, especially in the springtime. Salt and ice damage shows up after spring rains. Weak sections just collapse after hard rain falls.
Filing a claim against the city only helps if the pothole was previously reported and more than 2 weeks has gone by without repair. FYI.
