From the detailed drawing it appears that you had plenty of room to avoid the pothole if traveling at the posted speed.

In all seriousness, with PD on scene stating that you appeared to be driving too fast to see the pothole I don't think you have much of a case. Even so it would probably cost you more in legal fees then replacing the rim and tire. Good luck.
